Goldyn Terms of Service

1. About Goldyn

Goldyn is operated by Opengro (Pty) Ltd, registered in South Africa (registration number 2010/008798/07), with its registered office at 1 Mimosa Avenue, Oudtshoorn, 6625, South Africa.

These Terms govern your access to and use of the Goldyn mobile application and related services. By creating an account or using Goldyn, you agree to these Terms.

Our Privacy Policy forms part of these Terms.

2. Eligibility

You must be 18 years of age or older to use Goldyn. By creating an account you confirm that you are 18 or older.

Account creation is blocked for people under 18 based on the date of birth entered at sign-up. If we discover that an account was created by someone under 18, we may suspend or delete it.

3. What Goldyn Is - and Is Not

3.1 What Goldyn is

Goldyn is a personal health tracking and education service. It helps you:

• Log how you feel through daily check-ins
• Upload and review your blood test results
• Receive AI-generated insights about patterns in your data
• Generate summaries to share with your healthcare practitioners
• Track medications, meals, exercise, symptoms, and related health information
• Keep notes, reminders, and support-circle sharing records

3.2 What Goldyn is not

Goldyn is not a medical device. It is not intended to diagnose, treat, cure, or prevent disease.

Goldyn does not diagnose. No output from Goldyn is a diagnosis.

Goldyn does not prescribe. Goldyn does not prescribe medication or treatment.

Goldyn does not replace your doctor. It is a tool to help you organise information and prepare for better conversations with qualified healthcare professionals.

Goldyn is not an emergency service. If you are experiencing a medical emergency, contact emergency services immediately.

4. The AI - Critical Disclaimer

Goldyn uses AI services, including Anthropic and OpenAI, to process some of your information. By using the service you acknowledge:

4.1 Non-diagnostic. AI outputs are informational and educational only. They are not medical advice, diagnoses, or treatment instructions.

4.2 Subject to error. AI systems can be inaccurate, incomplete, or misleading. Do not rely on Goldyn alone for health decisions.

4.3 No professional relationship. Your use of Goldyn does not create a doctor-patient relationship or any professional healthcare relationship.

4.4 Contextual limitations. The AI does not have access to your full medical history unless you have entered it. Important clinical context may be missing.

4.5 Emergency use prohibited. Do not use Goldyn as a substitute for emergency services or urgent clinical advice.

5. Your Account

You must provide accurate information at registration and keep it reasonably up to date. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

We may suspend or terminate accounts that breach these Terms, misuse the service, or are created by users who are not eligible.

6. Your Data

6.1 Ownership

You retain ownership of the health and personal data you enter into Goldyn.

6.2 Licence to us

You give Opengro (Pty) Ltd a limited licence to store, process, and use your data only as needed to operate Goldyn.

6.3 AI processing

By using Goldyn, you consent to your data being processed by the third-party providers used to run the service, including AI providers described in the Privacy Policy.

6.4 No sale of data

We do not sell your personal data.

6.5 Export and deletion

You can export your account data from Settings > Privacy. You can request account deletion from Settings > Delete account. Deletion runs with a 30-day cancellation window.

7. Support Circle

Goldyn allows you to invite supporters to view elements of your health data. You can revoke access at any time from Settings > Support Circle.

You are responsible for choosing who to invite and for the information you choose to share with them.

8. Acceptable Use

You agree not to:

• Use Goldyn for any unlawful purpose.
• Attempt to access another person's account or data.
• Upload malicious code or interfere with the service.
• Reverse engineer or abuse the app or its infrastructure.
• Use Goldyn as a substitute for emergency services or licensed professional advice.
• Use the service to process another person's health data without proper authority and consent.

9. Intellectual Property

Goldyn's software, design, branding, and related materials belong to Opengro (Pty) Ltd or its licensors. Your personal data remains yours.

10. Fees

Goldyn is currently a private alpha. If paid plans are introduced later, we will disclose the pricing and billing terms before charging you.

11. Disclaimers and Limitation of Liability

11.1 Service provided "as is"

Goldyn is provided on an "as is" and "as available" basis. We do not promise uninterrupted service, error-free operation, or accurate AI output.

11.2 Health disclaimer

Goldyn is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read in Goldyn.

11.3 Limitation of liability

To the maximum extent permitted by applicable law, Opengro (Pty) Ltd will not be liable for indirect, incidental, or consequential damages, or for health outcomes arising from reliance on Goldyn's outputs.

Our total liability to you for any claim is limited to the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) ZAR 500.

12. Third-Party Services

Goldyn depends on third-party providers such as Supabase, Anthropic, OpenAI, PostHog, and Loops. Their services may affect how Goldyn operates, and they have their own terms and privacy commitments.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Disputes: Contact us first at privacy@opengro.com. If unresolved within 30 days, disputes shall be referred to the courts of South Africa.

14. Changes to These Terms

If we make material changes, we will update the version and date above and may also notify you in the app or by email.
